The Islamic Republic of Iran became the 148th contracting state of the Patent Cooperation Treaty this month, depositing its instrument of ratification on July 4th, 2013. As with all new PCT members, Iran will be bound by the PCT three months from the date of accession, meaning that any international application filed or or after October 4, 2013 will automatically designate Iran. This also entitles all nationals and residents the option of filing internationally via the PCT.
Additionally, Iran will automatically be elected in any demand for international preliminary examination under Chapter II of the PCT. This allows applicants the right to demand IPE of his/her international application and elect which contracting states he/she intends to use the results.
