Hello everyone.  WIPO released their first PCT Newsletter for January 2014 and we have compiled some highlights for your consideration.

Four more Offices have signed up to pilot the PCT Patent Prosecution Highway, bringing the number of participating Offices to 17.  The four most recent countries to join the Global PPH Pilot are as follows:

  1. The Hungarian Intellectual Property Office
  2. Icelandic Patent Office
  3. Israel Patent Office
  4. Swedish Patent & Registration Office

Poland (PL)

As of October 2013, any patent attorney registered to practice before the Patent Office of the Republic of Poland may act as an agent.

International Bureau (IB)

As from January 1st, 2014, there will be the following fee changes payable to the IB as a receiving office:

Friday Foreign Filing Roundup

Hi everybody! This is what we found in the way of foreign filing news from the week of Feb. 4th (it’s already February!):

  • One report found that the number of patents being filed in the U.S. has increased by “historically high levels.”
  • Colombia recently named several patent offices (the EPO and the Russian Federation, among others) as new International Preliminary Examining Authorities for local applicants.
  • WIPO has updated its PCT Fee Tables to account for slight changes in international filing fees.
  • How are online portals changing the traditional law firm ecosystem? Two experts weigh in>
  • What inventions do you most wish to see in the near future? The techies at Huffington Post compiled their list, and some of these may just line up with yours!

Next month, WIPO’s PCT Newsletter will celebrate its 20th anniversary.  They invite readers to send thoughts and reflections on the past 20 years to pct.legal@wipo.int, where you can expect certain excerpts to be included in the anniversary issue. Amendments to the PCT Regulations

The following amendments to the PCT Regulations will go into effect on July 1, 2014:

  • (i) requiring International Preliminary Examining Authorities to conduct a “top up” search during international preliminary examination, subject to various exceptions (addition of PCT Rules 66.1ter and 70.2(f)) and
  • (ii) allowing written opinions of the International Searching Authority (in their original language) and informal comments submitted by the applicant in response to such opinions (in their original language) to be publicly available from the date of international publication (deletion of PCT Rule 44ter and amendment of Rule 94.1(b))
  • The text of the amendments was reproduced, in English and French, in the Official Notices (PCT Gazette) on 6 February 2014 and the consolidated text of the Regulations under the PCT, as in force from 1 July 2014, will be available shortly before the entry into force of the amendments.
