Your privacy mattersRWS Holdings PLC and affiliate RWS Companies (together RWS) specialise in providing technology-enabled linguistic, content and intellectual property services to its corporate clients.
RWS is committed to respecting your privacy through appropriate protection and management of the personal information you provide to us when applying for (i) roles or (ii) service contract positions with the RWS Group through our Recruitment Portal (Portal).
This Privacy Notice describes the personal information we collect, how we use it and share it, in the context of the provision of our Portal, and your rights.
Why and how do we collect your personal information?
RWS will collect your personal information directly from you for the purposes of managing your application during our recruitment process through our Portal with a view to offering you (i) an employment contract or (ii) a service contract with an RWS Group organisation.
Specifically, we process your personal information for the following purposes:
- To take steps at your request in view to entering into an employment contract or service contract;
- As per our legitimate interests:
- To assess your suitability for the role you applied;
- To help us develop and improve our recruitment process;
- To authenticate you when logging on to our Portal;
- For internal audit and reporting obligations;
- For internal analysis of aggregated statistics;
- For the prevention and detection of fraud;
- For the prevention and detection ofsecurity incidents.
- To fulfil legal or regulatory requirements with respect to verifying right to work;
- Based on your consent, to retain your CV further to an unsuccessful application in order to contact you for future career opportunities.
We will also pass to our third-party provider your name and email to carry out pre-employment background screening when offering you a position and entering into an employment contract to the extent permitted by applicable law and as per our legitimate interest. This provider will contact you to submit certain personal information directly to them.
For the avoidance of doubt, RWS does not receive the personal information you have submitted in that regard to our provider; and this process does not apply to candidates applying to service contract positions.
What personal information do we collect?
RWS will collect the following information:
- Name and surname;
- Contact details (address, telephone, email);
- Length of time spent in country of residence;
- Stated majority age;
- Internet Protocol address;
- Title;
- Education, training and qualifications;
- Language skills;
- Current and/or desired salary;
- Curriculum Vitae;
- Interview and assessment (tests) information.
With whom do we share your personal information?
To fulfil the purposes described above, we will share your personal information with our third-party contractors:
- Our Portal service provider;
- Our assessment providers to perform required tests (your name and email);
- Our compliance provider to prevent fraud (your name and email);
- Our pre-employment background screening provider (your name and email).
Our third-party providers act for, on behalf of, and under the instructions of RWS, and are required to adhere to our policies, procedures and processes and to comply with applicable data privacy laws.
RWS may also share your personal information with other third parties if required to do so by law.
In accordance with the California Consumer Privacy Act, in the preceding twelve (12) months, RWS confirms it has not sold any personal information.
Do we transfer your personal data externally?
Given the international nature of our Services, personal data transfers will need to be made both internally within the RWS group, and externally to our third-party service providers described above.
Where your personal data is transferred to a country which is not governed by a data protection law affording a similar or adequate level of data protection than that in force in your country of residence, or to which no adequacy decision has been issued by the relevant European Commission, RWS has taken steps to ensure an adequate level of protection of the transferred data in the country of transfer by entering into appropriate data transfer agreements such as those based on the European Standard Contractual Clauses (also known as European Model Clauses) issued by the European Commission. This will enable the safeguarding of your information in the overseas country.
With respect to RWS’s intra-group personal data transfers from the European Economic Area to third countries, a copy of the applicable documentation can be obtained from RWS using the Contact details below.
How long do we retain your personal data?
We will retain your personal data to fulfil the purposes described above, and to respond to your enquiries including data subject requests, comply with our legal obligations such as tax, audit and financial reporting, within the limits prescribed by applicable regulations, and to preserve evidence for the management of disputes, claims or litigation.
With respect to roles applied within the RWS Group:
For successful applicants, we will retain your data during your employment contract, and for 6 years post contract termination.
With respect to service contract positions:
For successful applicants, we will retain your data during the contract period, and for 3 years post contract termination.
If you are unsuccessful in your application for a role or a service contract, we will retain your data for up to 6 months* from the date notifying you of your unsuccessful application, unless you have agreed to our retaining your details in our talent pool for a period of up to 2 years. If you say yes, we will proactively contact you should any further suitable roles arise.
*unless local applicable law requires a longer retention period.
How do we ensure your personal data is safe?
Your Rights
RWS is committed to complying with applicable data protection and privacy laws and regulations including but not limited to the European General Data Protection Regulation (‘GDPR’), the UK Data Protection Act (‘UK DPA’), the California Consumer Privacy Act (‘CCPA’), the Brazil general data protection law (‘LGPD’).
Under applicable data protection and privacy laws and regulations, you are entitled to several rights in relation to the processing of your personal data.
You have a right of access and rectification of the personal data RWS processes about you.
Upon legitimate grounds, you also have a right to erasure (right to be forgotten) of your personal information.
Depending on your country of residence and upon legitimate grounds, you also have a right to restrict the processing of your personal information, a right to object to the processing, and a right to data portability of the personal data you have provided to us in certain circumstances.
You also have a right to lodge a complaint with your local Supervisory Authority responsible for overseeing the processing of personal data. In the list of RWS Companies are details of the relevant Supervisory Authorities per country in which we operate.
